Falling behind on mortgage payments without coming to an agreement to repay the arrears may result in the mortgage company taking action in the county court to gain possession of the property.

The lender will first issue a claim form which will include a date and time for you to attend a hearing at your local county court.

It is very important that you attend the hearing, even if you have replied to the claim form. You will have an opportunity to put your payment proposal before a District Judge.

The hearing will take place in a private room and only you, the District Judge and the solicitor for the landlord/lender will be present. If the District Judge believes your offer is reasonable they are likely to grant a suspended possession order.

That allows you to stay in your home providing you continue to pay the ongoing mortgage plus the agreed amount towards your arrears.

If you want to stay in your home but find that you are having difficulty in paying you should seek our advice immediately.

At any time before the eviction date an application can be made to the court to suspend action on the grounds that you can retrieve the situation. You will have to convince a Judge of this.
